Indian property rights

Albany 18 January 1818

Dear Sir,

I have been in Albany ever since the first of this month + have the whole time been too unwell to enjoy business or the table, but now feel rather better + hope that a few days quiet at home will completely restore me.

The law in relation to conveyances made by Indians in the high road of revolution. In a cause argued last August the Court have decided that the conveyance of an Indian Patent died before the date of the Patent does the act of 5th of April 1803 give [office] to the grant! The Indians were not "officers and soldiers serving in the line of this state or in the army of the United States." The question is now before the Court and in relation to one of your notes, which others are quarrelling about, the court say that the act of 1803 does apply to Indians - your title I think will be established.

Yours Sincerely
Daniel Cady

Peter Smith Esq.
